      Important Notice from the Keys HOA

      The Keys HOA special vote on hot tub policy scheduled for,

      Saturday, April 30, 2016, 10:00-10:30 AM,

      will be held at the pool cabana on Settlers Lane instead of the clubhouse.

      The issue has been clearly delineated; the only item on the agenda is the vote to amend the Covenants.

      In lieu of attending the meeting, your absentee ballot can be returned by mail or turned in at the office

      by Friday, April 29 at 5:00 PM.

      At 10:30, the results of the vote will be tabulated and announced.  The results will also be sent out by email and posted on the Keys website.

      Keys HOA Board Meeting at the KBV Clubhouse

      The next board meeting is scheduled for Saturday April 23th at the Kure Beach Village Clubhouse at 10:00am.  As always, these are open meetings to all Keys owners and we invite you to attend.

      Agenda for this meeting is as follows.

      1.Votes taken by email since last meeting:

      4/13/16           The board approved an exterior change form for 668 Settlers Lane to replace the front window.

      4/11/16 The board voted to renew a CD at Live Oak Bank (currently at $51,000) for two years and add $50,000 to it by transfer from the money market account.  The interest rate will be 1.5%

      4/7/16             The board approved an exterior change request to add a second floor window to 642

      Sloop Pointe Lane.

      3/28/16           The board voted to appoint Micki Hobson to fill a board vacancy until October, 2017.  She will chair the landscaping committee.

      3/25/16           The board voted to authorize Charles Meier to meet with a representative from the Dunes to further explore sharing the costs of pond maintenance.

      3/4/16             The board approved the 2/27/16 Keys HOA Board meeting minutes.

                Keys HOA Board Meeting at the KBV Clubhouse

                Hot Tub in the Keys

                Kure Keys is a community with covenants, bylaws, and rules and regulations.  Each owner has an opportunity to read and become familiar with these documents prior to purchase. The HOA Board governs the association on a volunteer basis to ensure that our community is in compliance with the covenants, bylaws, and rules and regulations and when challenged, that there is a fair and equitable process to reach a solution to the issue.

                One of our residents has requested the installation of a hot tub on her deck.  Currently this is not permitted according to covenants.  The Board unanimously voted not to support her request for the following reasons:

                1. The covenants currently allow for hot tubs to be installed on the screened-in back porch.
                2. The covenants are in place to help to protect property values.  It is the Board’s opinion that allowing hot tubs on decks could jeopardize those property values.
                3. Hot tub usage would be difficult to monitor:
                • It would fall to the Board members to monitor usage and respond to complaints at all times of day and night.
                • Noise from the back of homes radiate to all areas of the neighborhood.
                • Residents of townhomes with the back master bedroom on the first floor may be affected even more by the presence of a hot tub and the noise created by its users because it is in close proximity to that bedroom.
                • Residents with extended decks could place their hot tub directly next to their neighbor’s bedroom window.  Again, adjacent neighbors could be impacted by the operation of the hot tub and the noise of its users.
                1. The Board cannot ensure that residents will properly maintain and operate a hot tub.  This could create unsightly untidiness for neighbors and also create a need for a set of hot tub rules and regulations.
                2. While most residents will respect neighbors as far as time of hot tub use and noise generated from its users, there is no guarantee that this will continue with visitors or future owners.

                As a point of information, the Board has approved a hot tub installed on an outside deck of one of the Kure Keys homeowners.  It was approved based on legally required documented compliance with the Americans with Disabilities Act (ADA) of 1990.  Upon sale of that residence, the current owner, at his own expense, must remove the hot tub and return the deck to the original configuration.

                        The Geese Issue in The Keys

                        To Keys Residents

                        As many of you have been told or personally witnessed, the board is putting forth a final attempted to have the geese relocate.

                        This started several years ago when the Board was informed by Retention Pond Services (the Keys pond maintenance contractor) that if we didn’t do anything the geese population would continue to increase and with the following consequences.  (This spring 2 by fall 20 and next year 40.)

                        1. Geese will eat the retaining grasses around the pond.  Maintaining these grasses is part of the maintenance of the pond and is covered by our permit with North Carolina Department of Environmental Assistance.
                        2. The cost of repairing these grasses to keep our permit could run into the thousands of dollars.
                        3. Large population of geese in retention ponds such as ours leads to Fecal Coliform colonies that are harmful to humans and domestic animals.  This also is a concern of North Carolina Department of Environmental Quality Department of Environmental Assistance & Customer Service and fines could be imposed.
                        4. Geese droppings on land are a potential health issue for animals and humans.
                        5. The pollution of the pond could result in the pond being contaminated.

                        These consequences where also supported by our landscaper (who has observed the negative impact of large geese populations at other retention ponds) and a professional wildlife management expert.  Based on the above, the Board requested options on how to get the geese to leave.  We where informed by the above professionals of the following:

                        1      Plant a ledge of vegetation around the pond cost $25 to $35 K

                        2      Have the wildlife management expert collect the geese and destroy them

                        3      Hire a herding dog at $1300 a month

                        4      Placing a fence around the pond before they breed and keep the gosling out.

                        5      Blinking light (disrupt sleep)

                        6      Dog silhouette

                        The Board chooses the bottom three, least cost.

                        None of these actions where initiated by the Board.  Actions where initiated based on, professionals advising the Board on what actions should be taken.  Also, at the last membership meeting in October 2015, it was presented to the membership to

                        1.  Do nothing further,

                        2.   Hire a herding dog, or

                        3.  Try the fence one more time.

                        It was agreed to by the members present to try the fence again.

                        If you agree that goose droppings on our driveways, streets, common areas and retention pond are a problem and want to help in our effort to have the geese relocate please contact a Board member to see how you can help.

                        We hope that the above will help the Keys residents understand the Boards actions.
